01 Eligibility

By using D.NIX., you represent and warrant that:

• You are at least 18 years of age, or the age of majority in your jurisdiction, whichever is higher.
• You have the legal capacity to enter into a binding agreement.
• You are not prohibited from using the Site under any applicable law, regulation, or court order.
• You are not accessing the Site on behalf of any entity that is subject to sanctions by the Government of India.
• You are not a person or entity that has previously been suspended, banned, or terminated from D.NIX. for any reason.

We reserve the right to refuse service to any person or entity at our sole and absolute discretion, without notice and without liability.

02 Description of Services

D.NIX. provides the following tools and services (collectively, "Services"):

• DNS Lookup — query any DNS record type against authoritative resolvers
• WHOIS / RDAP — domain registration and ownership data via direct registrar and RIR connections
• IP Intelligence — ASN, BGP prefix, RIR WHOIS, PTR records, and abuse contact lookups
• Email Health — SPF, DKIM, DMARC, MTA-STS, BIMI, and blacklist analysis
• DNS Propagation — global propagation checks across 200+ resolvers
• DNSSEC Validator — chain-of-trust validation including DNSKEY, DS, RRSIG, NSEC/NSEC3
• CT Log Search — SSL/TLS certificate transparency log queries
• Batch Lookup — bulk DNS health checks with CSV export
• Domain Compare — side-by-side DNS configuration comparison
• REST API — programmatic access to all tools via JSON API with key-based authentication

All Services are provided on an "as-is" and "as-available" basis. We make no guarantee of uninterrupted access, accuracy of results, or fitness for any particular purpose. We reserve the right to modify, suspend, limit, or discontinue any Service, feature, or tool at any time, with or without notice, and without liability to you.

03 Acceptable Use

You agree to use D.NIX. solely for lawful, legitimate purposes including personal research, system administration, network diagnostics, security analysis, and development.

You expressly agree that you will NOT use the Site or Services to:

• Conduct, facilitate, or support any activity that is unlawful under the laws of India or any applicable jurisdiction.
• Engage in reconnaissance, enumeration, or pre-attack intelligence gathering against any domain, IP, network, or system that you do not own or have explicit written authorisation to test.
• Automate queries in a manner that circumvents, bypasses, or subverts our rate limiting, CAPTCHA, or other access control mechanisms.
• Scrape, harvest, or systematically extract data from the Site or its outputs using bots, spiders, crawlers, scripts, or any automated means beyond the scope of the authorised API.
• Use the Services for bulk commercial data harvesting, resale of results, or building competitive intelligence products without our prior written consent.
• Submit queries intended to generate intelligence about systems belonging to third parties for malicious purposes, including but not limited to phishing infrastructure setup, spam campaign targeting, DDoS coordination, or domain hijacking.
• Probe, test, or attempt to exploit vulnerabilities in D.NIX.'s own infrastructure, APIs, authentication systems, or backend services without explicit written authorisation from us.
• Reverse engineer, decompile, disassemble, or attempt to derive the source code, algorithms, or logic underlying the Services.
• Impersonate any person, entity, or organisation, or misrepresent your affiliation or authorisation.
• Create multiple accounts for the purpose of circumventing rate limits, access restrictions, or any other usage controls.
• Share, resell, sublicense, or redistribute API keys or account credentials to third parties.
• Interfere with, disrupt, or degrade the performance of the Site, its servers, or networks connected to the Site.
• Inject malicious code, conduct SQL injection, cross-site scripting, or any other form of attack against the platform.
• Use the Services to support spam operations, including but not limited to verifying target email infrastructure, bulk MX lookups for spam delivery, or blacklist evasion.
• Access or use the Services in any manner that could expose us to legal liability or reputational harm.

Violation of this section may result in immediate termination of your access, reporting to law enforcement authorities, and civil or criminal legal action at our sole discretion.

04 Rate Limiting and Fair Use

To protect the integrity, availability, and performance of D.NIX. for all users, we enforce rate limits on all tools and API endpoints. These limits apply to all users, including anonymous users, registered free-tier users, and API key holders.

• Rate limits are determined solely by us and may be changed at any time without notice.
• Exceeding rate limits will result in temporary blocking of your IP address, account, or API key.
• Repeated or deliberate rate limit violations may result in permanent suspension without appeal.
• You must not attempt to circumvent rate limits by rotating IP addresses, using proxies, VPNs, Tor, distributed networks, or any other technical means.
• Using multiple accounts, API keys, or client identifiers to exceed the aggregate rate limit of a single account is a violation of these Terms.
• Any action that results in excessive load on our infrastructure — regardless of whether it technically triggers a rate limit — is a violation of these Terms and may be acted upon at our discretion.

We reserve the right to throttle, block, or permanently ban any source of traffic that, in our sole judgement, constitutes abuse, excessive use, or a threat to service stability.

05 CAPTCHA and Bot Protection

D.NIX. employs CAPTCHA and other bot detection mechanisms to protect the platform from automated abuse. By using the Site, you agree to the following:

• You will not attempt to solve, bypass, defeat, or circumvent CAPTCHA challenges using automated tools, CAPTCHA-solving services, machine learning models, or any other method.
• You will not use headless browsers, browser automation frameworks (e.g., Selenium, Puppeteer, Playwright), or similar tools to interact with the Site outside of the authorised API.
• Any programmatic access to the Site must be conducted exclusively through our official REST API using a valid, personally issued API key.
• CAPTCHA bypass or bot automation attempts are treated as a serious breach of these Terms and will result in immediate and permanent termination of access, in addition to potential legal action.

We reserve the right to upgrade, change, or remove CAPTCHA mechanisms at any time without notice. Temporary unavailability of CAPTCHA does not constitute permission for automated access.

06 API Access and API Key Usage

Access to the D.NIX. REST API requires a valid API key issued upon registration. By using the API, you agree that:

• Your API key is personal, non-transferable, and must not be shared with any third party.
• You are solely responsible for all activity conducted under your API key, regardless of whether you authorised that activity.
• You must immediately notify us if you suspect your API key has been compromised or used without your authorisation.
• We reserve the right to revoke, rotate, or suspend any API key at any time, with or without notice.
• API usage must remain within your allotted rate limits and quota. Exceeding quotas without upgrading to an appropriate plan is a violation of these Terms.
• Commercial use of API results — including resale, repackaging, or redistribution of data — requires a separate written commercial agreement with D.NIX.
• You may not use the API to build, train, or augment machine learning models, large language models, or AI systems using D.NIX. data without our prior written consent.
• We log all API calls including endpoint, input parameters, IP address, timestamps, and response codes. These logs may be used for abuse investigation, legal proceedings, or enforcement of these Terms.

Violation of API Terms may result in immediate key revocation, account termination, and, where applicable, legal action to recover damages caused by unauthorised or abusive API use.

07 Account Registration and Security

If you create an account on D.NIX., you agree to:

• Provide accurate, current, and complete information during registration and keep it up to date.
• Maintain the confidentiality of your account credentials, including your password and API keys.
• Accept full responsibility for all activity that occurs under your account.
• Notify us immediately at https://www.dnix.in/contact upon becoming aware of any unauthorised use of your account.
• Not create accounts using false identities, temporary email services, or disposable credentials for the purpose of evading restrictions.

We reserve the right to suspend or permanently terminate any account that violates these Terms, appears fraudulent, or poses a risk to the platform or other users — without prior notice and without any obligation to provide a refund or explanation.

08 Abuse Detection, Monitoring, and Enforcement

D.NIX. actively monitors all traffic, queries, API calls, and user behaviour for signs of abuse, violations of these Terms, and threats to platform integrity. You expressly consent to this monitoring as a condition of using the Services.

Our abuse detection systems may analyse:

• Query patterns, volume, and timing
• IP address reputation and geolocation
• User-agent strings and browser fingerprints
• API key usage patterns
• CAPTCHA interaction behaviour
• Correlation between account activity and known threat indicators

Upon detection of abuse or suspected violation, we may, at our sole discretion and without notice:

• Rate-limit, throttle, or block your IP address, account, or API key
• Permanently ban you from the Site and all associated Services
• Preserve and hand over logs and evidence to law enforcement or regulatory authorities
• Pursue civil legal action to recover damages, injunctive relief, or other remedies
• Publish anonymised or aggregated information about detected abuse patterns (without personally identifying you) to inform the security community

Our failure to act upon any particular violation does not constitute a waiver of our right to act upon subsequent or similar violations.

09 Intellectual Property

All content, design, code, branding, tool logic, APIs, data structures, and documentation on D.NIX. are the exclusive intellectual property of D.NIX. — Domain Network Intelligence Exchange and are protected under applicable copyright, trademark, and intellectual property laws of India and internationally.

• You may not copy, reproduce, modify, distribute, publish, sell, licence, or create derivative works from any part of the Site or its outputs without our prior written consent.
• You may not use the D.NIX. name, logo, or branding in any manner that implies endorsement, partnership, or affiliation without explicit written authorisation.
• Results generated by our tools are provided for your personal or internal business use only. Republication, mass redistribution, or commercial exploitation of results is prohibited without a written licence agreement.
• Aggregating or scraping our results to train AI models, populate databases, or build competing products is strictly prohibited.

Any unauthorised use of our intellectual property may result in legal action, including claims for damages, injunctive relief, and recovery of legal costs.

10 Third-Party Data Sources and Disclaimer of Accuracy

D.NIX. queries third-party authoritative data sources including DNS resolvers, RDAP/WHOIS registries, RIR databases (ARIN, RIPE, APNIC, LACNIC, AFRINIC), certificate transparency logs (crt.sh), and IP intelligence providers (e.g., Team Cymru). We do not control the accuracy, completeness, or availability of data from these sources.

• All results are provided "as-is" and are for informational purposes only.
• We make no warranties, express or implied, regarding the accuracy, currency, completeness, or reliability of any result.
• Results must not be used as the sole basis for legal, financial, security, or business decisions without independent verification.
• We are not responsible for any decision, action, or harm arising from reliance on results provided by the Services.

11 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, D.NIX. AND ITS OPERATORS, EMPLOYEES, DIRECTORS, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY:

• DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES
• LOSS OF PROFITS, REVENUE, DATA, BUSINESS, OR GOODWILL
• SERVICE INTERRUPTIONS, INACCURATE RESULTS, OR SYSTEM FAILURES
• UNAUTHORISED ACCESS TO OR ALTERATION OF YOUR DATA
• ANY OTHER LOSSES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SITE OR SERVICES

THIS LIMITATION APPLIES WHETHER THE CLAIM IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR AGGREGATE LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID US (IF ANY) IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12 Indemnification

You agree to indemnify, defend, and hold harmless D.NIX., its operators, affiliates, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to:

• Your use of the Site or Services
• Your violation of these Terms
• Your violation of any applicable law, regulation, or third-party right
• Any misuse, abuse, or unauthorised use of your account, API key, or credentials
• Any inaccurate information you provide to us
• Any harm caused to a third party as a result of your use of our Services

We reserve the right, at your expense, to assume exclusive control of any matter subject to indemnification. You agree to cooperate with our defence of such claims.

13 Disclaimer of Warranties

THE SITE AND ALL SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AVAILABILITY, SECURITY, OR NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

• THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE
• RESULTS OBTAINED FROM THE SERVICES WILL BE ACCURATE, COMPLETE, OR RELIABLE
• ANY ERRORS IN THE SERVICES WILL BE CORRECTED
• THE SITE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS

14 Suspension and Termination

We reserve the right, at our sole and absolute discretion, to suspend, restrict, or permanently terminate your access to any or all Services, with or without notice, and without liability, for any reason including but not limited to:

• Violation of any provision of these Terms
• Suspected or confirmed abuse, fraud, or misuse
• Conduct that we believe poses a risk to the platform, other users, or third parties
• Legal, regulatory, or compliance requirements
• Extended inactivity of an account
• Our business decision to discontinue the Service or any part thereof

Upon termination, your right to access the Services immediately ceases. We are under no obligation to retain or return any data associated with your account. Any provisions of these Terms that by their nature should survive termination shall continue to apply, including Sections 9, 11, 12, 13, and 16.

15 Privacy

Your use of D.NIX. is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Site, you consent to the collection and use of your data as described in the Privacy Policy.

16 Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Republic of India, without regard to its conflict of law provisions.

Any dispute, claim, or controversy arising out of or in connection with these Terms, the Site, or the Services shall be subject to the exclusive jurisdiction of the courts of India. You irrevocably consent to the personal jurisdiction of such courts and waive any objection to venue in such courts.

Prior to initiating any legal proceedings, you agree to first attempt to resolve any dispute informally by contacting us at https://www.dnix.in/contact and giving us thirty (30) days to respond and attempt resolution.

17 No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorised representative of D.NIX.

18 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

19 Entire Agreement

These Terms, together with our Privacy Policy and any other agreements or policies expressly incorporated by reference, constitute the entire agreement between you and D.NIX. with respect to the use of the Site and Services, and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.
